Orders

Orders, all personalised to the consumer's specifications, are taken into account from the day payment is received in full. Production time usually varies from 15 days to two months (excluding weekends, public holidays and annual leave) unless otherwise indicated. Items are sent by recorded delivery for items worth less than 50 euros and no thicker than 3 cm, or by colissimo (recorded delivery if the value of the parcel exceeds 100 euros). Please note: from the time of production, no request to change the personalisation or cancel the order will be considered, in accordance with current legislation.

Chérie et Dandy undertakes to ensure that delivery is made as quickly as possible. For information, the average time for orders made to the specifications of the Consumer (clothing and accessories) is 15 days to two months for the most elaborate items, except in special cases or bulk orders. In the event of foreseeable delays (due to complex specifications for example), Chérie et Dandy undertakes to inform the consumer in writing.

The orders, being made according to the specifications of the Consumer (personalized orders,...) could be neither exchanged nor refunded in accordance with the articles L.121-21-8 of the Code of the Consumption.

Deliveries

Transport of your parcel

The standard delivery method is Colissimo suivi, without signature for orders under 100 euros, with signature for orders over 100 euros. Orders worth less than 50 euros and of a small weight or size may be sent by recorded delivery (in accordance with La Poste regulations).

Shipping costs include packaging, handling and postage. They may contain a fixed part and a variable part depending on the price or weight of your order. We advise you to combine your purchases into a single order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Special care is taken with parcels containing fragile products.

Packages are oversized and protected.

Returns and exchanges

Orders are made to the specifications of the Consumer (custom orders, personalized orders, ...) and can in no case be exchanged or refunded.

Chérie et Dandy cannot be held responsible in the event of loss or damage.

Prices

Prices are indicated in euros, are not subject to VAT (article 293 B of the CGI) and do not include delivery costs. They may be modified at any time (in particular in the event of price increases by our suppliers or carriers, exchange rates).

Payment

Payments can be made by credit card (Visa, Mastercard, Carte Bleue, Maestro or Eurocard) or bank transfer.

Guarantee

In the event of a delivery error, the product will be exchanged and the cost of return by the customer will be reimbursed (rate for a simple colissimo). Delivery delays due to repair or replacement will not give rise to compensation. Wear and tear or deformation due to the use of the product cannot, of course, be considered to be a defect in the goods, nor can the product be used in poor conditions.

Legal Warranty

Chérie et Dandy is liable for defects in conformity of the goods sold in accordance with Articles L217-3 to L217-4 of the French Consumer Code.

Chérie et Dandy also remains responsible for the legal guarantee of hidden defects under the conditions set out in articles 1641 to 1648 of the Civil Code, as well as article 2232 of the same code.

When acting under the legal guarantee of conformity, the consumer:

-has a period of two years from the date of delivery of the goods in which to take action;

-may choose between repairing or replacing the goods, subject to the cost conditions set out in article L. 211-9 of the Consumer Code: "In the event of a lack of conformity, the buyer may choose between repairing or replacing the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. He is then obliged to proceed, unless this is impossible, according to the method not chosen by the buyer.

-The purchaser is exempt from having to prove the existence of a lack of conformity for a period of six months following delivery of the goods. This period is extended to twenty-four months from 18 March 2016, except for second-hand goods.

As a reminder, the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

The consumer may decide to invoke the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code, in which case they may choose between rescinding the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

Reservation of ownership

The goods delivered by Chérie et Dandy remain its property until full payment of the invoice.

Jurisdiction

The interpretation and execution of these general conditions of sale, as well as all the acts which will be the consequence, will be subjected to the French law.

In the event of a dispute concerning these general terms and conditions of sale, the French courts may be seised according to their jurisdiction.
